Texas doesn’t use the word “custody.” The Family Code uses conservatorship instead. A parent designated as a managing conservator holds decision-making authority over the child’s education, medical care, and legal matters. A possessory conservator has the right to possession and access but limited decision-making authority.
For unmarried mothers, Texas law provides an important default: when a child is born outside of marriage, the mother is automatically presumed to have sole managing conservatorship until paternity is legally established. She can make all legal, medical, and educational decisions for the child without the father’s involvement. Once paternity is established, the court evaluates both parents as equal candidates under the best-interest-of-the-child standard.
For mothers going through divorce, courts presume joint managing conservatorship is in the child’s best interest unless family violence or other disqualifying factors are present. The best-interest standard weighs each parent’s emotional and physical fitness, caregiving history, stability of the home, and the child’s specific needs. A mother who has served as the primary caregiver may have meaningful factors in her favor, but those factors must be clearly presented to the court.
